Representatives of Mental Fitness Inc. (MFI Representatives) may, at times, receive personal and private information that must be kept confidential. Some of the information obtained is necessary to provide programs and services to an organization, group or individual, and other information is shared within the development of a helping, trusting relationship. Before MFI Representatives begin serving as a member of the Mental Fitness team, they are made aware of the laws and penalties for breaching confidentiality.
Mental Fitness expects all staff, officers, directors, leaders, interns, volunteers and other representatives to respectfully keep confidential any personal or privileged information received through their position with Mental Fitness. Confidentiality is the preservation of privileged information. It means that MFI Representatives are not permitted to disclose the provided information, specifically, the names of program participants or to talk about them in ways that might make their identity known. No personal or privileged information may be released without appropriate authorization. General information, policy statements or statistical material that is not identified with any individual is not classified as confidential.
Personal or privileged information gained about individuals, groups and organizations through Mental Fitness is confidential in terms of the law, and disclosure could make MFI Representatives legally liable. Disclosure could also interfere with the ability for Mental Fitness to fulfill its mission by damaging relationships with our partners and the people we serve. Failure to maintain confidentiality may result in termination of an MFI Representative’s position with the organization. This policy is intended to protect MFI Representatives, as well as Mental Fitness, because in extreme cases, violations of this policy may result in personal liability. Although Mental Fitness is liable for an MFI Representative’s acts within the scope of their duty, giving information to an unauthorized person could result in the organization’s refusal to support the MFI Representative in the event of legal action. Violation of South Carolina state statutes regarding confidentiality of records is punishable upon conviction by fines, by imprisonment, or by both.
